THE APPLICATION OF MAQASID SYARIAH IN USING THE TECHNOLOGY OF PGD FOR SCREENING GENETIC DISEASES

Assisted Reproductive Technologies are an ever-expanding technology worldwide. Various technologies have been created, not only to enable couples to give birth even to help them get children free from any genetic disease. Preimplantation Genetic Diagnosis (PGD) is a technology that allows embryos to be screened to detect any genetic or genetic damage of the embryo before the implantation process is performed. As the world develops, Malaysia is also impressed with the use of PGD technology for various purposes especially to screen genetic diseases. Although the general guidelines on the use of PGD issued by the Malaysian Medical Council are available, there are no specific laws and regulations governing the use of PGD technology in Malaysia. The use of PGD technology for various purposes invites many issues and discussions from ethical, legal and religious aspects. The focus of the discussion in this paper is from the point of using PGD for the purpose of screening genetic diseases in Malaysia. This paper aims to clarify that the use of PGD technology for the purpose of screening genetic diseases in Malaysia needs to be based on clear fundamental principles. On that basis, researcher put the concept of maqasid syariah in Islam as a guideline on the formation of regulations regarding the use of PGD to be more holistic and perfect.
